Terry from Virginia that I had found during a visit to the library resulted in and email from Jeaneen Terry, a family researcher who has been working on the line for more than 25 years. She gave me a ton of leads, including the a copy of the will of the Thomas J. Terry in question. The will was of Fluvanna County Virginia, but was proved in Louisa County. Here is some more information, courtesy of Jeaneen:

Pamunkey Davenport Chronicles: http://www.pamunkeydavenport.com/
This is a family of Davis Davenport who lived next to Capt. Thomas Terry. Davis's son married Grace daughter of Thomas Terry. The first 15 pages tell a lot of information about early 1690 - 1720 Va.

Nicholas Mills Sr. lived on the other side of the Terry property before most moved farther west into Va. He had a son named Nicholas and this son had 2 daughters named Ann. Back then the families named each son after a male leader of the family or the wife's maiden name so others would know which family you were connected to. This would explain Mills Terry's name. The Mills family moved west to what is now Albemarle Co. but at the time it was still Hanover Co.. This too is something you have to watch for . COUNTY CHANGES. Note : Ann was also the Mother's and Grandmother's name.

Stephen son of Capt. Thomas Terry filed in 1699 claim in House of Burgess for land that was subleased from the Indians along with James edward and Lewis Davis.
Capt. Thomas Children: Stephen, Grace ( Thomas Davenport), Keziah ( Richard Davenport), Sarrah ( Edward Bradley ) , William, Daniel, and Gideon.

William Terry born England died Va. Children : James abt 1665 and Thomas abt. 1669 died 1735 His son Stephen was the Executor. This is the same Stephen to whom our Thomas was born. It's Not the Stephen born 1702 Hanover Co.

Capt. Thomas was listed as an Indian fighter, the last King William Magistrate and St. Margaret's Parish Church warden ( the first Justice of the Peace )

Quit Rents Rolls of 1704
James, Thomas and Stephen are listed on the Quit Rents Rolls of 1704 in King William Co.

Thomas 300 acres
James 400 acres
Stephen 330 Acres.

James and Thomas received land for transporting people to the Colony. At the time anyone paying 6 pounds Sterling for the trip would receive 50 acres. For those who couldn't pay they sold their service for a period of 4-7 years and the one who paid the transportation got the land. The Terry's transported a good number of folk and were know to be men of wealth. Thomas aquired hundreds of acres. He lived approximately 15 miles up Pamunkey Neck

OUR Thomas Terry born 1732 Hanover Co. Died 8 Oct 1804 Louisa Co.
Revolutionary # S 7700 soldier of the Continental Line. Served under John Peyton's 3rd Va. Regiment.

DAR Patriot Index page 671 lists Thomas and wife Ann

Thomas's will was of Fluvanna County but, Proved in Louisa Co in 1804.

In Search of Thomas Terry

My daughter and I rode our bikes to the Pleasanton library this morning, and I took the opportunity to do a little research. Luckily for me, there was a docent there who pointed me to the website: http://www.familysearch.org . A quick search for the oldest known patriarch in the Terry line resulted in this record:

Lewis TERRY

  Male

--------------------------------------------------------------------------------

Event(s):

Birth: About 1764 , Fluvanna, Virginia

Christening:

Death: 06 AUG 1851

Burial:

--------------------------------------------------------------------------------

Parents:

  Father: Thomas TERRY Family

  Mother: Ann

--------------------------------------------------------------------------------

Messages:

Record submitted after 1991 by a member of the LDS Church. No additional information is available. Ancestral File may list the same family and the submitter.

--------------------------------------------------------------------------------

Source Information:

   No source information is available.

The date of death matches up nicely with the will I have for Lewis Terry, gives a birth date that makes sense in relation to that of his wife's, yet has a birthplace that doesn't match up with the information I have. Both pieces of birthplace info are unsourced. The parents' names also match those that I have from another source.

Next to search for a Thomas Terry who was married around the time of this Lewis' birth in the same location. Bingo!:

Thomas TERRY

  Male

--------------------------------------------------------------------------------

Event(s):

Birth:

Christening:

Death:

Burial:

--------------------------------------------------------------------------------

Marriages:

  Spouse: Ann

Marriage: About 1757 Of, , Fluvanna, Virginia

--------------------------------------------------------------------------------

Messages:

Record submitted after 1991 by a member of the LDS Church. Key is the location of Fluvanna, Virgina, which ties Lewis and Thomas together, at least tentatively.

Ann OR Terry

  Female

--------------------------------------------------------------------------------

Event(s):

Birth: About 1735 , , Virginia

Christening:

Death: After 1805 , Louisa, Virginia

Burial:

--------------------------------------------------------------------------------

Marriages:

Spouse: Thomas J. No additional information is available. Ancestral File may list the same family and the submitter.

--------------------------------------------------------------------------------

Source Information:

   No source information is available.

Different information on Ann. Note the date of birth only 1 year of the previous record. There was another Thomas Terry listed with a date of death in the same ballpark:

Thomas Terry

  Male

--------------------------------------------------------------------------------

Event(s):

Birth: 1740 , Chesterfield, Virginia

Christening:

Death: About 1789

Burial:

--------------------------------------------------------------------------------

Parents:

  Father: Joseph Terry

  Mother: Judith Crawford

--------------------------------------------------------------------------------

Messages:

Record submitted after 1991 by a member of the LDS Church. No additional information is available. Ancestral File may list the same family and the submitter.

--------------------------------------------------------------------------------

Source Information:

   No source information is available.

This appears to be a different Thomas Terry, and the one cited by my other source. More research is needed, but this new information puts into question the connection to the Crawford family line that I had hoped existed.

<br Unfortunately it was locked. I needed membership to view the information. Fortunately they offer a 14 day free trial. So I signed up. This may be the George Walter Terry in my family tree who is the son of Duncan and Wysetta. The owner of the family tree has made the connection. I'm not 100% certain. Here's the information:

George Walter Terry

Oct 14 1845 - Born in Georgia - fathers birthplace listed as North Carolina in all Arkansas census records*

Feb 26 1857 - Married Mary S. In addition he is listed with his family on the 1860 census. The information is not sourced.

Family Group

Mary S. In fact the Governor was petitioned to call another election, and among those signing the petition was Duncan Terry.

The book also includes the Muster Roll of the Murray County Rangers of 1838. "In January, 1838 a group of Murray citizens petitioned Governor George R. Gilmer to address the subject of their exposure to Indian hostilities. J.W.P. Buckanan and William McGaughy apparently led the effort. The men wanted a competent military force, composed of residents of the county and therefore best calculated to protect it, feeling that the time had arrived when it was indispensible to the safety of the people and property of the section. The mounted soldiers would be accepted as part of the U.S. forces protecting the frontier, but would be stationed in Murray. Some 80 men signed the petition and soon the Rangers were formed.

Among those listed on the muster roll were:
Terry, Wm.
Terry, G.C.
Terry, Duncan
Carder, Thomas

The book also describes the founding of the Holly Creek Baptist Church on July 21, 1848. Among those attending were Joseph Terry, Dovina Terry, Constantine Terry, Wysette Terry, and Julia Ann Terry. It was commented that Joseph Terry may have been an early pastor for the church. Census records record Duncan as being a former baptist minister, and it may have been here that he preached.

"Holly Creek has had several houses of worship. The first structure was located some 300 yards back of the present building and was also used as a school according to the deed from Duncan Terry to the church dated December 11, 1855. "

"George C. Terry once had a store and business on the Old Federal Road north of Holly Creek/Fort Mountain. He applied for a liquor license in the late 1830's."

"This well-known house was built by Joe Terry
and his sons in the 1890's"

The Terry's were an important family in Murray County Georgia, and they are mentioned often as the book progresses through the years and generations.

Also of note are the spellings of Terry women that I hadn't seen before. Wysetta, Wyzetta, or Wygetta, was spelled here Wysette. In fact we see Thomas Carder on Page 27, living with a female between 15 & 20, and a child under 5yrs.

Descendants of Lewis Terry - Generation No. 1

Back in February of 2002 I had a brief correspondence with Kaye Nichols, a genealogical researcher in Georgia. Her email failed shortly afterward, and I have never been able to get back in touch with her. She mailed me (via snail mail) a great genealogical report entitled "Descendants of Lewis Terry. " Being new to research and less diligent than I should have been, I entered the main points into my Family Tree Maker program and filed the hard copy. Then I exported a digital version from my FTM program and saved it to my hard drive.

As is usually the case, I was busy and wasn't able to get back to my research hobby for a number of weeks or even months. By that time I had forgotten about the hard copy, and assumed that Kaye emailed me the digital version.

To make a long story short, I just found the hard copy. Nine pages of great information. I won't have time to transcribe the whole thing for the website at one time, but will be blogging is bit by bit, and sending a copy via snail mail to my cousins.

So without further ado:

Descendants of Lewis Terry

Generation No. 1

1. Lewis1 Terry was born 1770 in Habersham County*, South Carolina. He married Constance. She was born 1765 in Virginia.

Children of Lewis and Constance are:
+ 2 i. George C.2 Terry, born July 07, 1810 in South Carolina; died January 01, 1888 in Murray County, GA.
+ 3 ii. William "Bill" Terry, born 1811 in Pendleton, South Carolina; died 1890 in Murray County, GA.
4 iii. Nancy Terry, born 1813 in South Carolina. She married Thomas Carder.
+ 5 iv. Joseph L. Terry, born March 12, 1814 in Pendleton, South Carolina; died August 23, 1880 in Darwar County, Texas.
+ 6 v. Duncan Terry, born December 25, 1816 in South Carolina; died 1862

* Various census records have Lewis Terry's birthplace in South Carolina. However the only Habersham County I have been able to locate is in Georgia, and was not created until 1818. The current location of Habersham County and the area once known as Pendleton District, South Carolina are less then 100 miles from each other. More research needed here.

Another item of note, that has been pointed out by other researchers, is that Constance would have been 51 years old at the time of Duncan's birth. It would be nice to have another source of information to confirm 1) the date of birth of Constance and 2) that Constance is actually Duncan's mother. Unfortunately the document I have doesn't list sources.

Louis Lafayette Terry Family

Here's some information sent to me on the family of Louis Lafayette Terry in OK.

Louis (Born 1888) and Ellen Terry had nine children, only three of which are living. She gave me the following information

In the 1850 census in Murray Co, GA, next door to Lewis Terry is the Harkins family. Nancy Terry, believed to be the daughter of George Terry, married Asbury Harkins. Asbury's brother, Tilman married Jane Elizabeth Terry. She was on the other side of the houses, in the
Carder household.

The family story is that Elizabeth and Nancy are sisters. When looking into application for Cherokee roll citizenship, both children of Nancy and Elizabeth list the same two people, one specifically listed as a grandmother. This makes them at least first cousins.

In a letter of information from Sarah Chastain, Tilman's sister, she states that Nancy D Pierce (Nancy Dovina Harkins Pierce, daughter of Tilman) is the 'daughter of Jane Harkins (nee Terry) whose great grandmother Nancy C Keith and who was the descendant of John Keith who
were Cherokee Indian by blood.' and continues 'said Nancy D Pierce's grandparent was Polly Smith, who was also Cherokee Indian by blood.'

On Nancy's application she states she is related to John Keith and 'Polly Smith, my grandmother.'

From information on your site I do not see Polly Smith or any Keiths. These Cherokee relatives must be on the Terry side as Sarah Harkins Chastain stated has no interest in the application. Terry of Murray County Georgia

The following are results of some great research conducted by my cousin, Ann, on a recent trip she made to Arkansas and Oklahoma.

Lewis A. Terry
Son of Duncan & Wysetta Terry
Born May 1853, Murray County, Georgia

We find Lewis Terry and his younger brother, Duncan Lafayette Terry living in Scott County Arkansas by 1880.

Duncan Lafayette "Fate" Terry (recorded as Delayafette in the AR 1880 census) is in Scott County for the 1880 census with his infant son, Louis Alexander Terry, his wife, Harriet Sliger Terry, and Harriet's young brother, James Sliger. Harriet's father and mother, W.C. and Hester McConnell Sliger, have both died before the 1880 census and their young children are in the homes of Harriet's two brothers - Pleasant W. Sliger and Francis Marion Sliger. I have found guardianship papers in Scott County court records naming these brothers as guardians.

Lewis Terry first appears in Scott County documents in 1880 and as follows:

1880
Scott County Arkansas Record of Guardian's Letters and Bonds, Volume A., Compiled by Delaine Edwards, May, 1994, published by Scott County Historical & Genealogical Society, PO Box 1560, Waldron, Arkansas 72958
Page 27: 8 October 1880, Waldron Amount: $250
L.A. Terry as guardian of R.L. Thomas, Minor.
Security: J.O.A. Sullivan

1882
From Scott County Coroner's Inquisitions, Transcribed by Carolyn Hanna, 2002, Published by Scott County Historical and Genealogical Society:
Mr. L.A. Terry is listed as a deputy sheriff of Scott Co. Arkansas and is deposed regarding the shooting death of W.T. Thomas on 7 July 1882. Mr. Dempsey makes a dying statement "to Mr. L.A. Terry, a deputy sheriff of Scott Co. Ark and that statement was reduced to writing by Mr. Terry and read over to Mr. Thomas before his death...." Later in the inquisition, L.A. Terry is interviewed and the interview is signed by him. Deputy Sheriff W.G. Jones...admitted her into the side-room of the jail house and turned the key and then went to the heavy jail door, unlocked it and presented Terry to his wife. Mr. Jones retired to the other end of the room leaving the couples at the end the door was in. He forgot to take the key from the lock...Terry made a dash for the door, turned the key and in a flash was out, running at breakneck speed...after a swift race Terry was overtaken by Dick Jones, brother of W.G. My daughter and (her children) my grandsons were with me. Donnie's son and grandson. Hettie's daughter and grandson. Louis' daughter and granddaughter. Each one had 3 generations. There was on link missing from the chain. That was Fate. I pray to God there will not be one missing when we stand around mother in our new home that Jesus has gone to prepare for us on high. And may God bless each child, grandchild and great grandchild.

Written Monday, May 26, 1941
Tags: arkansas, dugan, genealogy, midland, mosley, terry

Articles from the Scott County Citizen, 1889

Here are some articles sent to my by Si and Sharon Goodwin, featuring my Great Grandfather, Duncan Lafayette Terry and my Great Grandmother, Harriet Sliger Terry. My Grandfather, William Lafayette Terry was born in July of 1889, so he was on the way when these were written.

SCOTT COUNTY CITIZEN 17 May 1889
On last Sunday morning Mrs. Terry, wife of Lafayette Terry, a prisoner in the Scott county jail, put in her appearance at the jail building and asked leave to see her husband and to visit a few hours with him. Deputy Sheriff W.G. Jones… admitted her into the side-room of the jail house and turned the key and then went to the heavy jail door, unlocked it and presented Terry to his wife. Mr. Jones retured to the other end of the room leaving the couple at the end the door was in. He forgot to take the key from the lock…Terry made a dash for the door, turned the key and in a flash was out, running at breakneck speed…after a swift race Terry was overtaken by Dick Jones, brother of W.G. Martin Goodwin

The following is my transcription of a court document from 1891 regarding an assault charge filed by my Great Grandfather, Duncan Lafayette Terry against his brother-in-law, Martin Goodwin. Martin Goodwin was evenually found “not guilty.” Thanks to Si and Sharon Goodwin for sending me the copy!

United States of America
Western District of Arkansas
Before Stephen Wheeler, United States
Commissioner
United States vs. Martin Goodwin
Assault
See Complaint and Endorsements Thereon Filed Herewith
On the 3rd day of Dec 1891
came the United States of America, the Plaintiff in this cause, by ……. U.S. Attorney defendant in his own person, in custody of the Marshal and by his Attorney Peal Byers when the following testimony was heard and proceedings had, to-wit:

Robert Barnes being duly sworn deposes and says:

I reside in Paola (?), Indian Territory and know the defendant in this cause…There was a little dance at our house during Cotton picking. DFT(defendant)? & Terry were there. Defendant walked across the room and said he was the best man in the house. Terry rose up and said he was not. I got Terry to sit down and I got things quieted. And afterwards Goodwin came in and repeated the remark. I got things quieted again and got him out of the house and took him into another house. After staying in there a while he got out of the window, and he and Terry got together and had a fight on the porch. After the fight was I saw that Terry had a cut on his hand. I do not know how it was made. I saw no knife during the fight.

Cross Ex

I do not know how the fight commenced on the porch or who struck the first lick.

Lafayette Terry, being duly sworn says:

Defendant and I were at the dance at Barnes. Everything went on smoothly until Goodwin got up on the floor and said he was the best God damned man in the house except his friends. I got up on the floor and said it was not so. Bob Barnes told me to not be too fast and I sat down. Goodwin went back and first I know he came back and sat down beside me or near me and said boys why aren’t you dancing. He was asked to go home, but he said he was not ready yet. They asked him what he was waiting on. He said he did not know unless it was Jesus Christ to move the spirit. He sat there a few minutes, then raised up and stamped the floor and said I am the best God damned man in the house except my friends. I saw he had his knife in his hand and I raised up and picked up a chair and and Bob Barnes caught Goodwin and run him out of the door. They kept him out in the hall a while and then I went out on the porch and Barnes told me they they had got him shut up in the other house. Bob Barnes went to get my children so I could go home and while I was waiting for them the window raised and I heard some one say “hello boys” and he came down to within two or three steps of me and said “I am the best God damned man on the hill.” I put my hand out against him and caught him by the shirt bosom, he squatted and struck me on the hip with something, and when he straightened up I hit him with my fist and staggered him back a little and tried to hug me. About that time someone caught me and while I was being held I threw my hand up and Goodwin cut me in the hand. Someone grabbed Goodwin and ran off with him. That ended it. He struck at me several times with his knife during the fight, but only cut me once. He cut the back of my coat with another lick. Defendant and I married sisters and have not been on good terms since he married my sister-in-law. We are both white men. This occurred about the 27th of Oct last.

Cross Ex.

I have served 2 years in the Columbus Penitentiary for introducing and selling whiskey. Defendant was drinking that night. I had not been drinking. I hit defendant 3 or 4 times during the fight.

Lewis Sherfield, a witness for defendant duly sworn says:

I was at the dance and saw the fight on the porch. Terry struck the first lick. Defendant just came out of the room and said “Hello boys” and walked up to Terry. Terry struck him. I had been there a couple of hours when the difficulty occurred. I saw Goodwin have ? during the difficulty. I had Goodwins knife in my pocket at the time. I did not see any cut on Terry and never heard anything about it until next day. I and Goodwin left immediately. We went right off the porch together and went to our mules and went home.

Cross Ex.

After the fight was over I did not wait to see if Terry was hurt but left immediately. I would judge the Goodwin was drunk. His mother had got me to see after him as he was drinking.

Nancy Sherfield a witness for defendant:

I was in the house where Goodwin raised up and said he was the best man in the house. Terry raised up with his hand on the back of a chair. Goodwin was rushed out of doors and some one threw a chair at him. I did not see who it was. We came there about an hour before the difficulty. I was out on the porch when the fight occurred out there. When Goodwin came out he said “Hello boys” and Terry said “I’ll make you think hello” and struck Goodwin. I did not see any knife. I heard no objection to Goodwin being there.

Cross Ex.

The difficulty occurred as late as 11 o’clock or later. My husband and I had been there about an hour when the difficulty occurred. Goodwin came there after we did. He left his wife at home and came over there late at night and got drunk and raised the row that broke up the dance and then went home

<link rel='alternate' type='text/html' href='http://personspast.blogspot.com/2009/06/assault-1891-style-united-states-vs.html' title='Assault, 1891 Style: United States Vs. I think I'm interested because I want to know where I come from, why I am like I am. I don't have time to do a lot of research now, but a few years ago I did a bit, and put up a family history Website. Through that site I came in contact with a number of relatives who now supply me with research.

My cousin Ann, who is devoting her winter to researching the Terry line has come up with some interesting info. First she found the court records showing that in July of 1889 my Great Grandpa, Duncan Lafayette Terry, or "Fate" for short, was convicted on 4 counts of "Introducing and Selling Liquor in the Indian Country," and was sentenced to serve 2 years in the Ohio Penintentiary. Bummer.

Penitentiary records describe him physically as a man of 5'10 3/4" height, greenish blue eyes, light brown hair and fair skin. They also cataloged his scars and marks, and gave a more detailed description, but I'll save that for the Website. Another page describes his habits as "intemperate." So he was a drinker. Who cares, you say? Well, it's interesting to me, and if that's wrong, I don't want to be right.

Next up, Uncle Louis "Luke" Terry: Arkansas Deputy Sheriff convicted of manslaughter and tried for murder (after he got out of jail for the first crime). I have the transcript for the preliminary hearing of the latter trial. Interesting stuff.
